Fairsky representing LG won retrial at the Supreme Court
Back in 2015, LG INNOTEK CO., LTD. (hereinafter referred to as “LG”) filed a civil suit against Nidec (Dongguan) Limited (hereinafter referred to Company N) , a WOFE of Japanese company NIDEC Corporation, for infringing upon LG’s Chinese patent No. ZL200820135640.3 and obtained favorable judgement of the first and second instance. After receiving a favorable decision on invalidating most of the claims under the patent at dispute, based on which the infringement was affirmed, Company N requested retrial of the case by the Supreme Court. Given the critical situation of the case, LG decided to entrust Fairsky with the retrial proceeding.
With the collaborating firm focusing on having the invalidation decision canceled by Beijing IP court, Fairsky litigation team built up an effective strategy in preventing the case from being arraigned. After holding an inquiry hearing with both parties elaborating their views, the Supreme Court made a civil ruling, supporting the claims of Fairsky team and rejecting the retrial request of Company N.
