Fairsky Law Won Patent Infringement Suit against SPACELAB Weightlessness Restaurant in First Instance

HEINEMACK GMBH is the patentee of Chinese invention patent No. ZL 200680037518.6 for a restaurant servicing system using rail transmission to deliver meals from kitchen to dining area by means of gravity. It owns more than 20 family patents / patent applications worldwide, and operates roller coaster restaurants in Hamburg, Europapark, and Dresden in Germany, Alton Towers Park in UK, Vienna in Austria, Sochi in Russia, and Abu Dhabi in UAE, etc. (http://www.rollercoasterrestaurant.com/en/).

Fairsky Law Office representing the Chinese licensee of the patent, Roller Coaster (Beijing) Catering Management Co., Ltd., filed a civil suit against Xi’an Happy Planet Catering Management Co., Ltd. for infringing upon the above patent, which was affirmed by Xi’an Intermediate People’s Court.

The defendant has affiliate restaurants in Beijing, Shanghai, Shenzhen, Suzhou, etc., among which the weightlessness restaurant in Beijing was the earliest. Back in March 2019, Weightlessness (Beijing) Catering Management Co., Ltd. filed a request for invalidation of the patent at issue which as maintained per CNIPA decision No. 41958 on the basis of amended claims.

While the first-instance judgement is still subject to appeal, very likely this popular restaurant will have to put a stop to its business.
